1. ABOUT THESE TERMS
Welcome to PulsiQ.
These Terms & Conditions govern your use of the PulsiQ website and your purchase of products through our online store.
By using our website or placing an order, you agree to these terms.
PulsiQ is a business operating in Kenya and these terms are intended to operate in accordance with applicable Kenyan law.
2. OUR PRODUCTS
We aim to ensure that product descriptions, photographs, specifications, prices and availability displayed on the website are accurate.
However, colours may appear slightly different depending on your screen or device.
For products that may have different variants, specifications or conditions, the applicable product listing will provide the relevant information.
For used, refurbished, open-box or EX UK products, the condition of the individual item should be clearly stated before purchase.
3. PRICES
All prices displayed on the website are in Kenya Shillings (KES) unless otherwise stated.
Prices may change from time to time.
A price change will not affect an order that has already been accepted and confirmed, except where there has been an obvious pricing or listing error.
4. ORDERS
When you place an order, you are making a request to purchase the selected products.
After receiving your order, we may send an order confirmation by email, SMS or WhatsApp.
An order may be cancelled where:
- The product is unavailable;
- There is a genuine pricing or listing error;
- Payment cannot be verified;
- We reasonably suspect fraudulent activity; or
- Other circumstances prevent us from fulfilling the order.
Where appropriate, payments for cancelled orders will be refunded through the applicable payment method.
5. PAYMENT
We may support payment methods including:
- M-Pesa
- Card payments
- Other payment methods displayed at checkout
Customers should only make payments through the payment channels officially provided by PulsiQ.
We will never ask you to send your M-Pesa PIN, card PIN, OTP or account password.
6. DELIVERY
We deliver within Kenya through our selected delivery partners.
Delivery times may vary depending on:
- Destination
- Product availability
- Courier operations
- Weather
- Public holidays
- Other circumstances outside our reasonable control
The estimated delivery timeframe displayed at checkout is an estimate and not necessarily a guaranteed delivery time.
7. RECEIVING YOUR ORDER
Please inspect your package when you receive it.
If the package appears damaged or the product appears incorrect, contact us as soon as reasonably possible and provide photographs or other relevant information where requested.
8. RETURNS & EXCHANGES
Our Returns Policy explains when an item may qualify for return, exchange or other remedy.
Nothing in our policies is intended to remove or restrict any consumer right that cannot lawfully be excluded under applicable Kenyan law.
9. WARRANTIES
Where a product includes a PulsiQ warranty, manufacturer warranty or other stated warranty, the applicable terms will be communicated on the product page, invoice or warranty documentation.
For products specifically advertised with a 3-month PulsiQ warranty, the warranty applies subject to the stated warranty conditions.
10. WEBSITE USE
You agree not to:
- Misuse the website;
- Attempt unauthorized access;
- Introduce malicious software;
- Copy or reproduce website content without permission;
- Use the website for fraudulent activity; or
- Interfere with the normal operation of the website.
11. INTELLECTUAL PROPERTY
The PulsiQ name, logo, website design, original photographs, graphics, written content and other original materials are owned by or licensed to PulsiQ unless otherwise stated.
You may not reproduce or commercially use these materials without permission.
12. PERSONAL INFORMATION
We collect and process customer information necessary to operate our business, including processing orders, payments, delivery and customer support.
Our Privacy Policy explains how we handle personal information.
Kenya's Data Protection Act, 2019 provides data subjects with rights including being informed about processing, accessing their data, objecting to processing and requesting correction or deletion in applicable circumstances.
13. CHANGES TO THESE TERMS
We may update these Terms & Conditions from time to time.
The latest version will be published on this page with the relevant effective date.
14. GOVERNING LAW
These terms shall be interpreted in accordance with the laws of Kenya.
Where a dispute arises, we will first attempt to resolve it directly and reasonably with the customer before pursuing any other available remedy.
